SYNOPSIS: The response, signed by Richard Cambra for William Withycombe, noted the records would logically be at the ASH-West office, and no emails of other records were found. It continues, stating that four people were “telephonically advised of the change of the word ‘inappropriate’ to ‘appropriate’: Teri Bristol, Stephen Goodman MD, Cindy Lopez-Hickson, and C. Rosslyn Marable.” One last interesting note: the letter has a paragraph rejecting the assertion this incorrect and unsubstantiated ROI was the ‘sole record’ used for the firing; i.e., Withycombe is directly contradicting writing statements in two records from summer/fall 2008, that declared the ROI was the sole record, prior to the 11/6/08 firing.

SYNOPSIS: This 9/1/11 FOIA REQUEST sought just one email, which had been sent from Dick Fossier to Ros Marable, on 4/5/08. The existence of this one email was indicated by a printout of the emails produced in early 2010, when FAA HQ officials did an archival search responsive to F10-3984. When the F10-3984 copies were first produced in September 2010, it was immediately clear that some emails were missing. So a followup FOIA request sought a printout simply listing all emails located in the archival search. This 4/5/08 email, with a subject line of “SFO Hot Issues”, appeared to be VERY relevant to the Lewis case. Some emails were exchanged into mid-October 2011. The 11-1-11 FOIA RESPONSE was signed by Lirio Liu and redacted roughly three lines; by context, it was clear that these b(5) redactions were not appropriately done. The APPEAL was filed on 11/28/11. A 1/26/12 APPEAL RESPONSE revealed some redacted content, but also sustained roughly one line worth of redactions.

SYNOPSIS: Using data from earlier FOIA responses, a list was compiled showing fourteen AB Cases, mostly for inappropriate hostile behaviors including racial comments, sexual comments, and rumors. The request sought printout copies. Two items on the list did NOT include AB Case numbers (due to excessive redactions by FAA officials). RESPONSE was received 11/22/11 and included 20-pages; it did NOT include copies for which the request did not provide the actual AB Case number. Redactions  were justified using b(6). An APPEAL was filed on 11/28/11. An APPEAL RESPONSE received 4/2/12 revealed the gender references (he, she, male, female, etc.) but continued to redact all other previously-redacted details.

SYNOPSIS: Dick Fossier was an LR Specialist at AWP-16, the FAA’s regional office that drafts letters of removal and otherwise assists managers in disciplinary actions. He was in charge of LR aspects of the Lewis-FAA Case for the first fourteen months that I was locked out (and mostly paid), from February 2007 until April 2008. Of course, this extensive involvement was concealed, thus not known to me until years after the failed MSPB process of early 2009. So, once Dick’s involvement was revealed in later FOIA responses, I submitted a new FOIA request in May 2011, hoping to get all relevant emails from his archived daily backup tapes. FAA officials did not want me to get copies, so they delayed and then, after many months, Tim Kubik sent another of his pay-to-play letters. He said I had to agree to an $800 fee estimate, or they would close the request in twenty days. One year earlier, Mr. Kubik was responsible for sending me the FOIA response to F10-3984; it was 260-pages, involved doing not one but THREE separate HQ/IT backup tape searches, and produced a total fee of $16. Yes … sixteen-dollars for three searches in 2010, vs. $800 proposed for one search in 2011.
NOTE, 6/14/13: this one may have been closed by FAA, but I have asked for confirmation.

This 3/17/11 FOIA REQUEST asked for printouts to clearly define all emails that were produced via each HQ/IT search. FOIA#2011-4258 Specific Don Bobertz emails re Lewis-FAA Case, from July 2008.

SYNOPSIS: Don Bobertz is the AWP-7 junior attorney who worked under Naomi Tsuda in the legal manipulations of the Lewis-FAA case. Documented involvement of AWP-7 starts in early July 2008. Mr. Bobertz concurred on the removal proposal letter (early July) and on the removal decision letter (late October), prior to the 11/6/08 firing. He failed to fully assess the case. After the firing, when an MSPB Appeal was filed, Bobertz continued to be active, and he signed the forced-voluntary retirement settlement on 3/4/09. He submitted all paperwork for FAA’s response to the PFR (5/4/09), and continues to be the AWP-7 person in charge of dealing with the Lewis-FAA case.

SYNOPSIS: Many rounds of sloppy work. Originally filed 3/8/11, and a series of delays produced a 90-page response, received on 5/25/12. That was appealed on 6/4/12, with a 9-page Appeal letter and 16-pages of Appeal Exhibits. Corrected records (14p) were provided via a 7/31/12 letter. Based on these corrected records, I filed a new Appeal on 8/9/12. A response to the earlier appeal (dated 6/4/12) was received on 9/20/12. Because this Appeal was specifically responsive to the 6/4/12 appeal, it did not address the more timely issues in the later appeal (8/9/12). A 10/31/12 email to Duke Taylor, Melanie Yohe and Kathy Ray (at DoT) sought to clarify this; nobody responded. The same email was forwarded on 6/14/13, seeking a response. FAA officials need to respond to the 8/9/12 FOIA Appeal, by providing the emails used to transmit the Terminal Reports (as requested in the FOIA), as well as true versions of the specified records that were improperly replaced with substitute records.

(II)*FOIA#2011-2662 Seven Years of Hotline Printouts for SFO, SJC, CCR, APC and RHV.

SYNOPSIS: FOIA requested via 1/18/11 letter, asking for all Administrator Hotline printouts for all cases filed after 1/1/04, out of five California towers (APC, CCR, RHV, SJC and SFO). Joann Noonan sent a 1/19/11 Acknowledgment letter. A 4/18/11 letter signed by Clay Foushee provided 70-pages of attachments, with numerous spot redactions and 23-pages fully redacted, citing FOIA Exemption #6. A 3-page Appeal was filed 5/15/11. Appeal acknowledged with a 5/24/11 letter signed by Mary Thompson. Two years later, the 5/10/13 Appeal response was a 3-page letter and 12-pages attached, revealing a few redactions but still sustaining most.

(I)*FOIA#2011-2330 All WSA-Terminal AB Case Reports for five years (2006-2011).

SYNOPSIS: The request sought all AB Case Reports for a five-year period, for which Teri Bristol, Kathryn Vernon, Mark Reeves or any other WSA served as ‘Accountable Official’. Eight AB Cases were specifically excluded as having been already received via earlier FOIA responses (see F10-8212 for an approximate list of the excluded AB Case numbers). Attached was a sample: a copy of a heavily-redacted F08-0160 AB Case Report (this is the case where the Tucson TRACON Manager improperly charged his secretary with being too friendly, and then got in trouble himself for trying to influence the testimony by his subordinates). RESPONSE was dated 11/9/11; 2p cover letter signed by Tina Amereihn, plus 97-pages of responsive records, heavily redacted citing b(6).  APPEAL filed 11/28/11 (4p total). APPEAL RESPONSE received sixteen-months later, on 3-22-13, included a 4p cover letter and 99p of attachments; some of the redactions were revealed; oddly, a second FOIA exemption 7(c) was added to the Appeal Response.

SYNOPSIS: REQUEST was dated 12/29/10 and included a single Vicki Hendrickson email, which had two attachment icons referring to AB Briefing Items distributed in May 2007. The FOIA asked for copies of all Briefing Items for five years worth of WSA-Terminal AB Cases, beginning in 2006. RESPONSE was received on 2/28/11, signed by Michael O’Harra, with Ron Beckerdite also responsible for numerous redactions, all b(6). A FOIA fee of $150 was paid. A subsequent analysis was completed in July 2012. Other FAA records were cross-referenced to produce a concise, 3-page color spreadsheet showing the chronology and details of five years worth of WSA-Terminal AB Cases. A very insightful read showing the lack of professionalism in ATC as well as the arbitrariness of  FAA management in their disciplinary responses. (I)*FOIA#2011-2164 Key Records in Four Disciplinary Cases.

SYNOPSIS: The four cases were the April-2008 firing of the manager at NCT; a threatened June-2008 firing of a controller at ONT (he quickly retired, the week before he was to get his letter); a female controller at SFO who was put on extended leave after protesting when she was being too-intimately observed during a May-2008 pee-test; and a TRACON manager at Tucson, who was threatened with a May-2008 suspension for interfering with an investigation and making hostile charges against a subordinate. Four interesting cases. A new FOIA was filed 12/29/10, and it was acknowledged with a 1/3/11 letter. Two responses both produced no records; the first was a 1/19/11 letter from AWP Security (managed by Ed Jones); the second was a 2/1/11 letter from AWP’s HRMD (managed by Tim Kubik). An Appeal was filed on 2/14/11. FOIA Appeals are supposed to be  finished in one month; this one took 28-months. A 6/3/13 Appeal Response declared that no ROI’s were done,  and only the first case (firing of the NCT manager) produced disciplinary letters. It also provided no Douglas Factors (yet, she was fired; they had to do Douglas Factors!), and it said there was no settlement at MSPB (the MSPB records indicate this is false). Also, there are other FAA records that repeatedly declare the Tucson TRACON manager was disciplined, which contradicts the FOIA Appeal Response.

Then, a 28-month delay until the Appeal Response (5/10/13) was received on 5/16/13; it had 49-pages, but FAA continues to fully redact the three CCR-PG AHIS filings from late 2006.

REQUEST:
11-15-2010.. A paragraph deep in the back of FAA’s FOIA Order (Order 1270.1) states that FAA has a ‘National Tracking System’ (NTS) database used to manage FOIA workload. The paragraph also notes that FAA must retain the NTS data for six years. Lewis requested NTS printouts for three of the earliest FOIA requests. His initial request also asked for the records produced during records searches for these FOIA requests. However, he withdrew this portion of the request during a subsequent phone conversation with FAA’s FOIA Manager, Duke Taylor.
RESPONSE:
11-24-2010.. The response was received on 11/27/10, and consisted of a 1-page cover letter signed by Duke Taylor, and 6-pages of responsive records.
NOTES:The NTS ‘Request Detail Report’ was discovered as a useful tool for explaining the FOIA process, and identifying the sources of some of the many FOIA delays. Subsequent to F11-1388, NTS searches were done, including F11-3188 (seeking NTS printouts for F8-0107, F8-7242, and F8-7407; F11-6663 (seeking NTS printouts for F10-3984 and F8-7242(Appeal).  The F11-3188 FOIA Request produced an extensive printout for F8-7407, related to key records provided by Teri Bristol and Barry Davis at WSA Terminal Ops; unfortunately, those key records were never released via FOIA, but were sent to the AWP Counsel (Naomi Tsuda and Don Bobertz), where they were concealed.
